Adv. Aires Rodrigues has today moved an application before Lokayukta Justice Ambadas Joshi urging him to send a Special report to Goa Governor over the decision of the Government not to register an F.I.R against Cumbarjua MLA Pandurang Madkaikar in the disproportionate assets case.

Adv. Rodrigues has drawn the attention of the Lokayukta that in terms of Section 16 (3) of the Lokayukta Act a Special report can be sent to the Governor by the Lokayukta when it is not satisfied with the response of the Government. Adv. Rodrigues has further pointed out that the Director of Vigilance in his one sentence letter sent to the Lokayukta has not given any reasons or justification as to why the recommendations of the Lokayukta have not been accepted by the Government.

Former Lokayukta Justice P.K.Misra on 15th September last year had directed the Anti-Corruption Branch (ACB) to register the F.I.R while censuring then Chief Minister Manohar Parrikar and former Chief Secretary Dharmendra Sharma besides then SP of ACB Priyanka Kashyap for their mishandling of the disproportionate assets  case against Pandurang Madkaikar   while observing that they had  shirked and shied away from their responsibility by not registering an F.I.R and not conducting an investigation against Pandurang Madkaikar.

While directing the Chief Secretary and the ACB to register an F.I.R in the disproportionate assets complaint filed by Adv. Aires Rodrigues against Pandurang Madkaikar, then Lokayukta Justice Misra in his 15 page order also observed that the then Chief Secretary Dharmendra Sharma and the ex SP of ACB Priyanka Kashyap had entirely failed in discharging their duty in accordance with law. Stating that appropriate punishment was required to be imposed on SP Priyanka Kashyap, the Lokayukta directed that Suo Motu proceedings be initiated against her for gross dereliction of duty.

After holding a preliminary inquiry into the complaint filed by Adv. Aires Rodrigues, the Lokayukta in his order held that reasonable grounds exist for conducting a detailed investigation while also observing that after going through all the material on record it could not be said that the complaint filed by Adv. Rodrigues against Pandurang Madkaikar was frivolous or vexatious.

Adv. Aires Rodrigues on 7th June 2018 had filed a complaint with the Lokayukta over the inaction of the ACB in probing the complaint filed by him against Pandurang Madkaikar. Pointing out that Pandurang Madkaikar’s Nikitasha Realtors Pvt Ltd had on 1st April 2017 inaugurated a huge palacial bungalow at Old Goa estimated to have cost around a whopping 200 crores, Adv. Aires Rodrigues in his complaint had demanded that the ACB register an FIR under Sections 13(1) (d) & (e) of the Prevention of Corruption Act 1988 and Section 120-B of Indian Penal Code against Pandurang Madkaikar and his wife Janita Madkaikar the Sarpanch of Old Goa and to speedily investigate the case.

Adv. Rodrigues along with his complaint gave the ACB photographs of the bungalow and a copy of the Affidavit dated 13th January 2017 filed by Pandurang Madkaikar along with his nomination papers at the 2017 Assembly Elections. Adv. Rodrigues drew the attention of the ACB that in his Income-tax returns for the financial year 2015-16 Pandurang Madkaikar had shown his total income for the year as a mere Rs 1,44,389 and that of his wife Janita, a paltry sum of Rs 24,389.

Adv. Rodrigues in his complaint stated that amongst his other liabilities and dues Pandurang Madkaikar had shown a Personal loan of 10 lakhs he had taken from Shiv Samarth Motors owned by Porvorim MLA Rohan Khaunte and another Personal loan of 5 lakhs obtained from his brother Dhaku Madkaikar. Adv. Rodrigues further stated that amongst Janita Madkaikar’s other liabilities and dues, was a Personal loan of 10 lakhs she had obtained from Rajesh Khaunte the brother of Rohan Khaunte and another Personal loan of Rs 6, 24, 361 she got from her husband Pandurang Madkaikar.

Stating that a perusal of the Affidavit of assets and liabilities filed by Pandurang Madkaikar evidently reveals that the construction of the new palacial bungalow at Old Goa was clearly disproportionate to the known source of income of Pandurang Madkaikar his wife Janita, Adv. Rodrigues also drew the attention of the ACB that Pandurang Madkaikar had in his affidavit shown that he owned only one residential building at Old Goa in Survey No. 143/1 with the plot admeasuring 875 sq mts and the total built-up area 580.7 sq mts valued at Rs. 69,68,400/

A complaint has today been filed by Adv. Aires Rodrigues against Mandrem MLA Jit Vinayak Arolkar on the illegal grabbing and fraudulent sale of property admeasuring 1,48,800.00 sq. mtrs at Dhargal in Pernem Taluka bearing survey no 481/0.

The complaint has been filed by Adv. Rodrigues before the Special Investigation Team (SIT) at the Crime Branch on instructions and under due authorisation of his client Mr. Rawloo Vaikunth Khalap, a Senior Citizen aged 76, native of Mapusa but now residing at California in the United States of America.

Pointing out that a hilly landed property known as “Kapni Voril Ghera”, bearing Survey No. 481/0, admeasuring 1, 48,800.00 sq. mtrs situated at Dhargal was co-owned by Late Vaikunth Shet Khalap and Late Sadashiv Sakharam Natekar, Adv. Rodrigues has stated that on the death of Vaikunth Shet Khalap on 13th August 1979 and his wife Shaila Vaikunth Khalap on 24th November 2007 that his client Rawloo Vaikunth Khalap is now one of the co-owners.

Adv. Rodrigues in his complaint has stated that Jit Arolkar based on a Power of Attorney dated 24/12/2012 deceitly executed between him and legal heirs of Late Sadashiv Sakharam Natekar took over the affairs of the and illegally created approx. 200 plots in the property between 8/11/2013 and 14/3/2018 while illegally and fraudulently executing sale deeds with third parties and selling the entire property without the express consent of all the legal heirs of the co-owners of the property.

The complaint states that despite the property being undivided and common with no partition of land or share carried out by any authority that by devious acts of the accused Jit Arolkar the Form I & XIV now reflects number of illegal mutation entries.

The complaint further states that the property is depicted as orchard land on the regional development plan and till date no conversion of land sanads have been issued by any authority or any conversion proceedings conducted before Dy. Collector of Pernem or North Goa Collector.

Adv. Rodrigues in his complaint has further stated that Jit Arolkar in gross violation of law with political patronage and funds allegedly generated through land scams has also funded and constructed tar roads illegally connecting to the village road and electricity poles also installed unlawfully while no action has been taken by the Electricity department and PWD.

Adv. Rodrigues in his complaint has further drawn the attention of the SIT that Jit Arolkar has also reportedly illegally created number of small plots in the adjacent property bearing Survey No. 498 and merrily in defiance of law has similarly illegally and fraudulently sold to various parties plots by executing similar devious sale deeds.

The complaint also states that the entire illegality, high-handed and systematic land grabbing scam that Mr. Rawloo Vaikunth Khalap has had to endure had been brought to the notice of various government departments but due to political clout enjoyed by the Jit Arolkar no action whatsoever has been taken.

Stating that Jit Arolkar had in 2001 joined the Goa Police as a constable only to quit within a decade possibly after making a huge fortune on land scams which is an issue that has to be investigated by the SIT, Adv. Rodrigues has along with the complaint submitted a copy of the affidavit filed by Jit Arolkar on 28th January this year before the returning officer along with his nomination papers for the Mandrem Assembly Constituency which reveals that Jit Arolkar has blatantly amassed very huge wealth beyond his known sources of income.

Seeking that the complaint be registered as an F.I.R against Jit Arolkar and be promptly investigated in accordance with law, Adv. Rodrigues has expressed the hope that the SIT will act without fear or favor despite the accused currently being an MLA supporting the ruling government. (GoaNewsHub)
